kABUL (Pajhwok): The parliament is expected to be inaugurated on next Saturday ahead of the announcement of final Wolesi Jirga election results of capital Kabul and Maidan Wardak province, a move called illegal by some experts.
The Wolesi Jirga election was held on October 20 and 21 in 2018 nationwide except Ghazni and Kandahar provinces. Elections in Kandahar held later.
The primary results of the election were expected to announce on November 8, 2018 and final results on December 20, but the results yet to be announced.
After new IEC commissioners took charge, final results from Balkh, Paktika, Ghor, Herat, Farah,
Logar, Helmand, Takhar, Nangarhar, Kandahar and for the Hindu minority seat have been announced so.
With final results from 29 constituencies yet to be announced, IECC said two days back that the Wolesi Jirga election results for the rest of provinces and the Kuchi constituency would be unveiled within a week.
Dr. Faroq Wardak, State Minister in Parliamentary Affairs, on Tuesday told Pajhwok Afghan News that the poll results of the rest of provinces, except Kabul and Maidan Wardak, would be announced on next Wednesday.
He said that people’s representatives would formally receive their credentials on Thursday and the parliament would be inaugurated on Saturday, April 27.
In response to a question, he said that the curriculm of the parliament would be completed with its inauguration, but its administrative board members election would wait until final results of Kabul and Maidan Wardak provinces announced.
A government official who wished to go unnamed, gave similar statements and said that representatives of Ghazni would continue their presence in the parliament until Wolesi Jirga election holds in the province.
According to the article three of internal duties rules of the Wolesi Jirga, the first session of the lower house would be held after official announcement of final Wolesi Jirga election results.
Based on this article, secretary of the house is responsible to inform the State Ministry for Parliamentary Affairs about the date and place of inaugural session of the house just a week after the announcement of final results of election and publish this information for the public.
Rahimullah Ghalib, deputy and acting secretary of Wolesi Jirga said that all necessary preparations of the inauguration of the parliament were in place.
In response to a question, he said, “The curriculum can be completed even if the final results of the Wolesi Jirga election not announced, there is no any legal problems in this area,”
However, Khan Aqa Rezayee, who was winner in the initial Wolesi Jirga election from Kabul, said, “Kabul residents would stop the government’s illegal move for inaugurating the parliament without the presence of Kabul representatives, the house members start and end their duties together and same time,”
“If the parliament inaugurated without the presence of some of representatives, it would mean that their rights are taken from electing the house administrative board members which is against the law,” he said.
The article 8 of the internal duties rules of the house say that speaker of the Wolesi Jirga for a legislative term should be elected through direct and secret votes in presence of majority of the house members.
On the other hand, Khan Aqa Rezayee said that Kabul candidates who were announced winners in the initial results of Wolesi Jirga election and their supporters, protest non-announcement of the final results of Kabul and would not let the parliament to inaugurate without their presence.
Meanwhile, Gul Ahmad Madadzai, a member of Afghanistan Lawyers Association, said, “Inauguration of the parliament when the final WOelsi Jirga results of some of the province are yet to be announced, is against the law, because parliament members start and end their duties on same time,”
He said that the government should not inaugurate the parliament until the final results of the election announced from all provinces.
